Piczo Copyright Policy

Piczo respects the intellectual property rights of others, including copyright. In order to comply with the U.S. Copyright Act, Piczo has adopted this Copyright Policy which applies to all users of its services, and which supplements the Piczo Terms of Service agreement.

Copyright Infringement Notification

If you feel that material posted on the Piczo website or on a member website hosted by Piczo infringes on copyright you own, you may send a written Copyright Notification to our designated Copyright Agent at the following address:

Your Copyright Notification needs to be in writing and include the following elements in order to ensure complete review of your request and compliance with the Copyright Act. Relevant copyright legislation in the country from which the material is posted may require additional information. Piczo reserves the right to request such further information if national legislation requires:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Piczo to locate the material;
  4. Information reasonably sufficient to permit Piczo to contact you, such as your full name, address, telephone number, and email address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Procedure for Take-Down of Web Pages and Notification to the Piczo Member

Upon receiving a Copyright Notification, Piczo will review the notification to make sure it complies with the requirements listed above and will review the member page that is claimed to infringe copyright. If Piczo determines that the Notification is valid, Piczo will disable access to the page and/or site.

If your page and/or site has been disabled due to a Copyright Notification, and you feel that your page and/or site does not infringe any rights held by the alleged Copyright Owner, you can send Piczo a Counter-Notification and request that your page and/or site be reinstated. You must promptly send the Counter-Notification in writing to the Copyright Agent at Piczo at the address listed above. Your Counter-Notification must contain the following elements in order to ensure complete review of your request and compliance with the Copyright Act:

  1. A physical or electronic signature of the Piczo member;
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;
  3. A statement under penalty of perjury that the Piczo member has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled; and
  4. The member's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the member’s address is outside of the United States, for any judicial district in which the service provider may be found, and that the member will accept service of process from the person who provided the Copyright Notification.

If Piczo receives a Counter-Notification, it will promptly provide a copy to the Copyright Owner who submitted the Copyright Notification, and will inform that person that Piczo will cease disabling access to the page and/or site in 10 business days. Assuming Piczo’s Copyright Agent does not receive notice within 10 business days that the Copyright Owner has filed a legal action against the Piczo member, Piczo will cease disabling access to the member page and/or site within 10-14 business days following receipt of the Counter-Notification.

Policy for Repeat Infringers

If Piczo learns that a member has repeatedly infringed copyright owned by others, Piczo may terminate the account of that member.

Changes

Piczo reserves the right to change these Terms at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in Terms of Service may also be superseded by provisions or notices published elsewhere on our site. Any changes made to these Terms will automatically be effective 30 days after they are posted on this page. If you continue to access Piczo after a notice of a change has been published, that means you are agreeing to the new Terms. If you do not agree to a change, you must terminate your membership with Piczo.
